Terms of Service

Premier Fingerprinting Plus LLC ("PFP," "we," "us," or "our")

This document is a general legal template tailored for PFP’s services in Washington State and North Idaho. It is not legal advice. For specific legal questions, consult a Washington‑licensed attorney.

  

1. Acceptance of Terms & Assent

By booking an appointment, visiting our locations, or using our services, you (the Customer) agree to these Terms of Service (Terms). If you do not agree, do not use our services.

We may update these Terms prospectively at any time. We will post the new effective date and, for material changes, provide reasonable notice. Continued use after the effective date constitutes acceptance of the updated Terms.

Plain‑English summary: These Terms explain what we do, what you agree to when using our services, and important limits (refunds, resubmissions, timelines, liability, and venue).

  

2. Services; Scope; Network Limitations

2.1 Core Services

We provide professional fingerprinting and identity‑related services, including:

  • Live‑scan capture: Electronic capture of fingerprints (flat and/or rolled).
  • FD‑258 ink cards: Ink cards printed on‑site; print‑to‑card from live‑scan      when applicable.
  • FBI Identity History Summary checks: Through an FBI‑approved channeler at      your request.
  • ATF .EFT files: Creation and delivery for eForms (Forms 1 & 4) and      related uses.
  • FDLE submissions: Florida Department of Law Enforcement fingerprinting for      approved purposes.
  • Archiving: If explicitly elected, short‑term secure retention to      streamline future submissions.
  • Apostille facilitation (FBI reports): Coordinating apostille services for FBI background check results when requested.

2.2 Network & Agency Limitations (READ CAREFULLY)

  • Third‑party enrollment network. For certain appointments (e.g., Washington State licensing/enrollments), we operate as a contracted enrollment site within a third‑party enrollment network. For those bookings, the network provider controls scheduling, pricing, eligibility, customer support, and refunds/reschedules. Our role is limited to verifying identity, capturing fingerprints, and submitting within that provider’s system. For changes or assistance, use the link/support info included in your confirmation.
  • Decisions & outcomes. We do not adjudicate or guarantee      licensing/clearance decisions. Agencies and recipients decide outcomes and timelines.
  • Misbookings. If you book PFP for a service that must be completed through a third‑party enrollment network or designated provider, we cannot process it at PFP. See Section 5 (Refunds & Resubmissions) regarding booking/processing fees.

2.3 Service Footprint

  • Primary service area: Spokane & Spokane Valley, WA, nearby Eastern WA communities; North Idaho (e.g., Coeur d’Alene) as announced.
  • Mobile/hosted stations: From time to time we operate pop‑up or hosted fingerprinting stations at partner businesses. These locations follow these Terms and our standards.

  

3. Eligibility

To use our services you must: (a) be at least 18 years old (minors require a parent/guardian present and consenting), (b) present valid government‑issued photo ID, (c) provide accurate and complete information, and (d) be legally authorized to submit fingerprints for the stated purpose.

  

4. Appointments; Communications; Required Documents

Scheduling. Book online or by phone. Walk‑ins may be available but are not guaranteed. Appointment times are subject to availability and operational needs.
Confirmation, arrival & messages. You’ll receive email and/or SMS confirmation (and reminders). By providing your email/phone, you consent to receive appointment updates and service messages (you can opt out of non‑essential messages at any time). Please arrive a few minutes early with required IDs/forms.
Required documents. Bring valid government‑issued photo ID (driver’s license, passport, state ID, or military ID) and any agency forms/ORI numbers/authorizations relevant to your request.
Late & missed appointments. Arriving 10+ minutes late may require rescheduling. No‑shows or cancellations with less than 24 hours’ notice may forfeit deposits/booking fees.

  

5. Fees, Taxes, Refunds & Resubmissions

5.1 Pricing & taxes. Prices are posted at booking and may change without prior notice. Some services require separate government or third‑party fees and are incorporated into our service pricing when possible. (e.g., channeler, ATF, FDLE, apostille, mailing/courier). Taxes are charged where applicable under state and local law (e.g., in Washington, fingerprinting/background screening services are taxable).

5.2 Payment. Payment is due at time of serviceunless otherwise stated. Apostille facilitation requires the related FBI report order first. We accept major credit/debit cards and other methods shown online or in‑store; cash may be accepted at select locations.

5.3 Refunds (CONSPICUOUS).

  • AFTER SERVICE IS PERFORMED, SERVICE FEES ARE NON‑REFUNDABLE.
  • BOOKING/MERCHANT PROCESSING FEES ARE NON‑REFUNDABLE ONCE PROCESSED and reflect third‑party costs incurred to reserve your slot and process payment. These fees disclosed before checkout.
  • GOVERNMENT/THIRD‑PARTY FEES (e.g., channeler, ATF, FDLE, apostille, mailing/courier) are NON‑REFUNDABLE once submitted.

5.4 Resubmissions for quality reject. If an agency rejects prints for quality, we provide one (1) complimentary reprint/resubmission within 30 days of the rejection notice for the same agency/recipient. Additional attempts may be billed at posted rates.

5.5 Equipment failure. If we cannot complete service due to our equipment failure, we will refund the service fee you paid to PFP for that visit.

  

6. Disclaimers

Our role. We capture and, where applicable, transmit fingerprints and related data. We do not adjudicate results or guarantee acceptance by any recipient.
No outcome guarantees. Processing times, acceptance, and decisions are controlled by requesting agencies, employers, or recipients—not by PFP. Any quoted timeframe is an estimate.
FBI channeling. Orders submitted to a channeler are non‑refundableonce submitted. We cannot guarantee FBI processing times.
Fingerprint quality. We use industry‑standard techniques/equipment and make reasonable efforts to obtain acceptable prints. Some individuals have prints that are difficult to capture due to age, occupation, skin condition, or other factors outside our control.

  

7. Customer Responsibilities

You agree to: (a) provide accurate information and valid identification; (b) follow staff instructions during capture; (c) review entries before finalizing appointments and promptly notify us of errors before final submission; (d) understand requirements of your requesting agency and provide correct ORI/codes/forms; and (e) acknowledge that results are provided by agencies/recipients—not by PFP. Providing false or inaccurate information may result in denial of service and potential legal consequences.

  

8. Privacy & Biometric Information

Your privacy matters. Our collection and use of personal information and fingerprints are governed by our Privacy Notice and Biometric Information Policy & Retention, incorporated here by reference. By using our services, you consent to the collection and processing of your data as described there, and you authorize transmission to designated recipients (e.g., channeler, ATF, FDLE, employers/agencies) at your request. When you follow links to a partner portal, your information is governed by that provider’s policy and terms.

  

9. Intellectual Property

Our website content, trade names, service marks, graphics, software, and materials are owned by PFP or our licensors and are protected by law. You may not copy, distribute, or create derivative works without permission; you may not reverse‑engineer any software we provide. Third‑party marks/content referenced on our site remain the property of their respective owners.

  

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PFP IS NOT LIABLE FOR: (A) AGENCY DELAYS, OUTAGES, OR DECISIONS; (B) REJECTIONS DUE TO INDIVIDUAL FINGERPRINT CHARACTERISTICS; (C) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; OR (D) LOST INCOME, EMPLOYMENT OPPORTUNITIES, LICENSES, OR OTHER DOWNSTREAM RESULTS OF ANY BACKGROUND CHECK OR DECISION.
CAP ON LIABILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A SPECIFIC SERVICE IS LIMITED TO THE AMOUNT YOU PAID TO PFP FOR THAT SERVICE.
Nothing here limits liability that cannot be limited under applicable law (e.g., for willful misconduct).

  

11. Indemnification

You agree to indemnify and hold harmless PFP and our owners, officers, employees, contactors, and agents from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of our services, (b) your violation of these Terms, (c) your violation of others’ rights, or (d) false/misleading information you provide. This indemnity does not apply to the extent a claim arises from PFP’s own negligence, willful misconduct, or violation of law.

  

12. Governing Law; Venue; Dispute Process

Governing law. These Terms are governed by the laws of the State of Washington, without regard to conflict‑of‑laws rules.
Venue. Exclusive venue for disputes is the state or federal courts in Spokane County, Washington. You consent to personal jurisdiction there.
Informal resolution. Before filing in court, contact us in writing and allow up to 30 days for good‑faith resolution.
Arbitration. The parties may mutually agree to binding arbitrationunder the American Arbitration Association’s rules, seated in Spokane County, WA. Either party may seek relief in small claims court for qualifying matters.
Equitable relief. Either party may seek injunctive or equitable relief in court to protect intellectual property, confidentiality, or data‑security interests.

  

13. Hosted/Partner Locations

We may operate hosted fingerprinting stations with local businesses. PFP provides equipment, training, and standards; the host provides space and may assist with intake. All services at hosted sites are provided under these Terms and PFP policies.

  

14. Prohibited Conduct

You may not: (a) use services for unlawful purposes or misrepresent your identity; (b) provide false information or someone else’s information without legal authority; (c) interfere with operations or attempt unauthorized access to systems/data; (d) harass or abuse staff; or (e) engage in fraud or misuse of results. Violations may result in service termination, denial of future service, and/or referral to law enforcement.

  

15. Force Majeure

We are not responsible for failures or delays due to events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, pandemics, utility/Internet failures, vendor or agency outages, and similar events.

  

16. Severability; Survival; Interpretation

If any provision is invalid or unenforceable, the remaining provisions remain in full force. Provisions that by their nature should survive (e.g., fees, privacy, intellectual property, disclaimers, limitation of liability, indemnity, governing law/venue) survive termination. Headings are for convenience only.

  

17. Entire Agreement; Order of Precedence

These Terms, together with our Privacy Notice(including Biometric Information Policy & Retention), are the entire agreement regarding our services and supersede prior understandings. If there is a conflict between these Terms and any posted policy specific to a service, the more specific policy controls for that service.

  

18. Assignment; Waiver

You may not assign these Terms without our prior written consent. We may assign to a successor or affiliate. Our failure to enforce a provision is not a waiver of our right to enforce it later.

20. Acknowledgment

By using our services, you acknowledge that you: (a) have read and agree to these Terms; (b) have read our Privacy Notice and Biometric Information Policy & Retention; (c) consent to the collection, use, and transmission of your information as described; (d) understand PFP is a capture/transmission service provider and does not control outcomes; (e) understand channeler orders are non‑refundable once submitted; and (f) had the opportunity to ask questions about our services and policies.
